(h) The Defendant may appeal to the Authority Head the decision denying a motion to reopen by filing a notice of appeal in accordance with § 13.26 within 15 days after the Presiding Officer denies the motion. The timely filing of a notice of appeal will stay the Initial Decision until the Authority Head decides the issue.

Upon receipt of an answer, the Reviewing Official will refer the matter to an Presiding Officer by filing the Complaint and answer in accordance with § 13.26.

(a) Any Defendant who has served a timely answer and who is determined in an Initial Decision to be liable for a civil penalty or assessment may appeal such decision to the Authority Head by filing a notice of appeal in accordance with this section and § 13.26.
