§218.237. Modifications of Letters of Authorization.

NMFS may modify the mitigation, monitoring, or reporting measures in a LOA issued under §§ 216.106 of this chapter and 218.236 of this subpart at the request of the Navy or NMFS' own initiative if:
The anticipated effects of the modified measure are the same as those described and analyzed for this subpart;
The modified measure has a reasonable likelihood of effectiveness;
NMFS determines the modified measure does not change the findings made for this subpart; and
Navy concurs with the modified measure and that, where applicable, it is practicable for the Navy in the context of personnel safety, practicality of implementation, and impacts on the effectiveness of the military readiness activity.
If modifications to the mitigation, monitoring, or reporting measures are substantial NMFS will publish a notice of the proposed LOA modification in the Federal Register and solicit public comment.
