§217.323. Prohibitions.
50 C.F.R. § 217.323
Except for the takings described in § 217.322 and authorized by a LOA issued under § 217.326 or § 217.327, it is unlawful for any person to do any of the following in connection with the activities described in this subpart:
Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or a LOA issued under this subpart;
Take any marine mammal not specified in § 217.322(d);
Take any marine mammal specified in § 217.322(d) in any manner other than as specified in § 217.322(a) and (b); or
Take any marine mammal specified in § 217.322(d), after NMFS Office of Protected Resources determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
