§217.263. Prohibitions.
50 C.F.R. § 217.263
Except for the takings described in § 217.262 and authorized by an LOA issued under §§ 217.266 or 217.267, it is unlawful for any person to do any of the following in connection with the activities described in this subpart:
Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or an LOA issued under §§ 217.266 and 217.267;
Take any marine mammal not specified in § 217.262(d);
Take any marine mammal specified in the LOA in any manner other than as specified in the LOA; or
Take any marine mammal specified in § 217.262(d), after NMFS Office of Protected Resources determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
