(i) Design, install, construct, initially inspect, and initially test the pipeline in compliance with this part, unless the pipeline is converted under § 195.5.(ii) [Reserved]

(b) Except for pipelines converted under § 195.5, the following pipelines may be operated without pressure testing under this subpart:(1) Any hazardous liquid pipeline whose maximum operating pressure is established under § 195.406(a)(5) that is—(i) An interstate pipeline constructed before January 8, 1971;(ii) An interstate offshore gathering line constructed before August 1, 1977;(iii) An intrastate pipeline constructed before October 21, 1985; or(i) Has its maximum operating pressure established under § 195.406(a)(5); or(4) Those portions of older hazardous liquid and carbon dioxide pipelines for which an operator has elected the risk-based alternative under § 195.303 and which are not required to be tested based on the risk-based criteria.

(c) Except as provided in § 195.5, no operator may operate any part of any of the following pipelines unless it was designed and constructed as required by this part:(1) An interstate pipeline, other than a low-stress pipeline, on which construction was begun after March 31, 1970, that transports hazardous liquid.(2) An interstate offshore gathering line, other than a low-stress pipeline, on which construction was begun after July 31, 1977, that transports hazardous liquid.(3) An intrastate pipeline, other than a low-stress pipeline, on which construction was begun after October 20, 1985, that transports hazardous liquid.

(1) The internal design pressure of the pipe determined in accordance with § 195.106. However, for steel pipe in pipelines being converted under § 195.5, if one or more factors of the design formula (§ 195.106) are unknown, one of the following pressures is to be used as design pressure:(i) Eighty percent of the first test pressure that produces yield under section N5.0 of appendix N of ASME B31.8 (incorporated by reference, see § 195.3), reduced by the appropriate factors in §§ 195.106 (a) and (e); or(ii) If the pipe is 12 3/4 inch (324 mm) or less outside diameter and is not tested to yield under this paragraph, 200 p.s.i. (1379 kPa) gage.

(b) Converted under § 195.5 and—(1) Has an external coating that substantially meets § 195.559 before the pipeline is placed in service; or

(b) Each buried or submerged pipeline converted under § 195.5 must have cathodic protection if the pipeline—(1) Has cathodic protection that substantially meets § 195.571 before the pipeline is placed in service; or
