§130.110. Consistency with the National Contingency Plan.

A railroad must certify in the response plan that it reviewed the NCP (40 CFR part 300) and that its response plan is consistent with the NCP.
At a minimum, for consistency with the NCP, a comprehensive response plan must include all of the following:
Demonstrate a railroad's clear understanding of the Incident Command System and Unified Command and the roles and responsibilities of the Federal On-Scene Coordinator;
Include procedures to immediately notify the National Response Center; and
Establish provisions to ensure safety at the response site.
