(e) The term handicapped person, as defined by the guideline set forth by the Department of Health, Education, and Welfare in § 85.31 of title 45 of the CFR (43 FR 2137, dated January 13, 1978), means any person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment.

(4) means:(i) Has a physical or mental impairment that does not substantially limit major life activities but is treated by the agency as constituting such a limitation.(ii) Has a physical or mental impairment that substantially limits major life activities only as a result of the attitudes of others toward such impairment; or(iii) Has none of the impairments defined in paragraph (1) of this definition but is treated by the agency as having such an impairment.OCR means the Office for Civil Rights of the Department of Health and Human Services.OCR Director/Special Assistant means the Director of the Office for Civil Rights, who serves concurrently as the Special Assistant to the Secretary for Civil Rights, or a designee of the Director/Special Assistant.Qualified individual with handicaps means:
