§4.790. What happens if the Board remands the case to the presiding officer?
43 C.F.R. § 4.790
If the Board issues a decision remanding a case to the presiding officer, the presiding officer:
May, subject to any directions or restrictions in the Board's decision and § 4.315, do one or more of the following to resolve any issues of fact or law:
Request information from the Project Director and the parties in interest or other persons or entities;
Schedule and hold a prehearing conference;
Schedule and hold a hearing; or
Take any other action authorized by this subpart; and
Will issue an order upon remand determining the issues of fact or law.
