§4.771. When must a petition for reopening be filed?

The Project Director may file a petition at any time. All other petitioners must file their petition within one year after the petitioner discovers the alleged error.
If the petitioner files their petition for reopening before the deadline for filing a petition for reconsideration under § 4.761(a), it will be treated as a petition for reconsideration.
