§435.115. Families with Medicaid eligibility extended because of increased collection of spousal support.

42 C.F.R. § 435.115

(a)
Basis. This section implements sections 408(a)(11)(B) and 1931(c)(1) of the Act.
(b)
Eligibility.
(1)
The extended eligibility period is for 4 months.
(2)
The agency must provide coverage during an extended eligibility period to a parent or other caretaker relative who was eligible and enrolled for Medicaid under § 435.110, and any dependent child of such parent or other caretaker relative who was eligible and enrolled under § 435.118, in at least 3 out of the 6 months immediately preceding the month that eligibility for the parent or other caretaker relative under § 435.110 is lost due to increased collection of spousal support under title IV-D of the Act.
