§423.2732. Use of third party administrator.

42 C.F.R. § 423.2732

(a)
CMS will engage a third party administrator (TPA) to assist in the administration of the Manufacturer Discount Program, which may include and is not limited to facilitating—
(1)
Manufacturer Discount Program invoicing;
(2)
The receipt and distribution of funds of a manufacturer; and
(3)
The dispute resolution process described in § 423.2764.
(b)
Agreement holders must—
(1)
Enter into and have in effect, under the terms and conditions specified by CMS, an agreement with the TPA in order to participate in the Manufacturer Discount Program. The TPA agreement will only terminate upon the termination of the Manufacturer Discount Program agreement; and
(2)
Establish and maintain electronic connectivity with the TPA for the purpose of timely transmission of data and funds.
