§423.1058. Dismissal of request for hearing.
42 C.F.R. § 423.1058
The ALJ may, at any time before mailing the notice of the decision, dismiss a hearing request if a party withdraws its request for a hearing or the affected party asks that its request be dismissed.
An affected party may request a dismissal by filing a written notice with the ALJ.
