§63.9917. How do I demonstrate initial compliance with the emission limitations and work practice standards that apply to me?
40 C.F.R. § 63.9917
For each affected source subject to an emission limit in Table 1 to this subpart, you have demonstrated initial compliance if:
You have met the conditions in Table 3 to this subpart; and
For each wet scrubber subject to the operating limits for pressure drop and scrubber water flow rate in § 63.9890(b), you have established appropriate site-specific operating limits and have a record of the pressure drop and scrubber water flow rate measured during the performance test in accordance with § 63.9916.
You have demonstrated initial compliance with the work practice standards in § 63.9891 if you have certified in your notification of compliance status that:
You have prepared a fugitive dust emissions control plan according to the requirements in § 63.9891 and submitted the plan for approval; and
You will operate according to the requirements in the plan.
