§42.400. Procedure; pendency.
37 C.F.R. § 42.400
A derivation proceeding is a trial subject to the procedures set forth in subpart A of this part.
The Board may for good cause authorize or direct the parties to address patentability issues that arise in the course of the derivation proceeding.
