§303.13. Early intervention services. — Inbound Citations

  • In addition to the terms referenced or defined in § 222.2, the following definitions apply to this subpart:
  • (1) The State has adopted a policy that appropriate early intervention services, as defined in § 303.13, are available to all infants and toddlers with disabilities in the State and their families, including—
    (i) Indian infants and toddlers with disabilities and their families residing on a reservation geographically located in the State;
    (ii) Infants and toddlers with disabilities who are homeless children and their families; and
    (iii) Infants and toddlers with disabilities who are wards of the State; and

  • (b) A State may establish, consistent with §§ 303.13(a)(3) and 303.203(b), a system of payments for early intervention services under part C of the Act, including a schedule of sliding fees or cost participation fees (such as co-payments, premiums, or deductibles) required to be paid under Federal, State, local, or private programs of insurance or benefits for which the infant or toddler with a disability or the child's family is enrolled, that meets the requirements of §§ 303.520 and 303.521.
