§35.2. To what programs or activities do these regulations apply?
29 C.F.R. § 35.2
Application. This part applies to any program or activity that receives Federal financial assistance, directly or indirectly, from DOL.
Limitation of application. This part does not apply to:
An age distinction contained in that part of a Federal, State, or local statute or ordinance adopted by an elected, general purpose legislative body that:
Provides persons with any benefits or assistance based on age; or
Establishes criteria for participation in age-related terms; or
Describes intended beneficiaries or target groups in age-related terms.
Any employment practice of any employer, employment agency, labor organization, or any labor-management joint apprentice training program.
