§71.97. Powers.
27 C.F.R. § 71.97
Administrative law judges shall have authority to:
Administer oaths and affirmations;
Issue subpoenas authorized by law;
Rule upon offers of proof and receive relevant evidence;
Take or cause depositions to be taken whenever the ends of justice would be served thereby;
Regulate the course of the hearing;
Hold conferences for the settlement or simplification of the issues by consent of the parties;
Dispose of procedural requests or similar matters;
Render recommended decisions in proceedings on applications for permits, and initial decisions in suspension, revocation, or annulment proceedings against permits;
Call, examine and cross-examine witnesses, including hostile or adverse witnesses when they deem such action to be necessary to a just disposition of the cause, and introduce into the record documentary or other evidence; and
Take any other action authorized by rule of the Alcohol and Tobacco Tax and Trade Bureau consistent with the Administrative Procedure Act.
