§1000.1835. Does the Tribe/Consortium have to return property used in the operation of a retroceded program?
25 C.F.R. § 1000.1835
On the effective date of any retrocession, the Tribe/Consortium must, at the option of the Secretary, return all property and equipment, and title thereto:
That was acquired with funds under the funding agreement for the program being retroceded; and
That has a per item current fair market value in excess of $5,000 at the time of the retrocession, or as otherwise provided in the funding agreement.
