§58.46. Time delays for exceptional circumstances.
24 C.F.R. § 58.46
The responsible entity must make the FONSI available for public comments for 30 days before the recipient files the RROF when:
There is a considerable interest or controversy concerning the project;
The proposed project is similar to other projects that normally require the preparation of an EIS; or
The project is unique and without precedent.
