§213.39. Exceptions to mandatory transfer.
22 C.F.R. § 213.39
USAID is not required to transfer a debt to the Financial Management Service (FMS) of the U.S. Department of the Treasury pursuant to § 214.37(b) during such period of time that the debt:
Is in litigation or foreclosure;
Is scheduled for sale;
Is at a private collection contractor;
Is at a debt collection center if the debt has been referred to a Treasury-designated debt collection center;
Is being collected by internal offset; or
Is covered by an exemption granted by Treasury.
