§252.167. Disclosure requirements for resolution Covered IHCs.
12 C.F.R. § 252.167
A resolution Covered IHC that has any outstanding eligible external debt securities must publicly disclose a description of the financial consequences to unsecured debtholders of the resolution Covered IHC entering into a resolution proceeding in which the resolution Covered IHC is the only entity in the United States that would be subject to the resolution proceeding.
A resolution Covered IHC must provide the disclosure required by paragraph (a) of this section:
In the offering documents for all of its eligible external debt securities; and
Either—
On the resolution Covered IHC's Web site; or
In more than one public financial report or other public regulatory reports, provided that the resolution Covered IHC publicly provides a summary table specifically indicating the location(s) of this disclosure.
