(1) Except as provided in paragraphs (a)(2) through (4) of this section, the head of the responsible NRC office, or their delegate, will make the initial determination either to grant or to deny in whole or in part requests for records. If disclosure is authorized, the head of the office or their delegate will furnish the agency records to the Freedom of Information Act and Privacy Act Officer, who will notify the requester of the determination.

(1) Whenever the NRC cannot meet the statutory time limit for processing a request because of “unusual circumstances,” as defined in § 9.13, and the NRC extends the time limit on that basis, the NRC will, before expiration of the 20-day period to respond, notify the requester in writing of the unusual circumstances involved and of the date by which the agency estimates processing of the request will be completed. Where the extension exceeds 10 working days, the NRC will, as described by the FOIA, provide the requester with an opportunity to modify the request or arrange an alternative time period for processing the original or modified request. The NRC will make available its FOIA Public Liaison for this purpose in accordance with § 9.25(c).

(5) A statement notifying the requester of the assistance available from the agency's FOIA Public Liaison, and the dispute resolution services offered by OGIS in accordance with § 9.25(c).
