This Act may be cited as the “Defense Community Infrastructure Program Tribal Eligibility Act of 2026”.
Defense Community Infrastructure Program Tribal Eligibility Act of 2026
A BILL
To amend title 10, United States Code, to include Indian Tribes in the defense community infrastructure program, and for other purposes.
Sec. 2 Inclusion of Tribal governments in the Defense Community Infrastructure Program
Section 2391 of title 10, United States Code, is amended—
in subsection (d)—
in paragraph (1)(A), by inserting “Indian Tribes,” after “local governments,”; and
in paragraph (2)(B), by striking “or local government” each place it appears and inserting “government, local government, or Indian Tribe”; and
in subsection (e)—
in paragraph (4)(A)(ii)(I), by striking “or local government” and inserting “government, local government, or Indian Tribe”; and
by adding at the end the following new paragraph:
“(7) The term Indian Tribe has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304).”
