Section 1 Short title
This Act may be cited as the “Detention Authority Clarification Act”.
Detention Authority Clarification Act
A BILL
To amend title II of the Immigration and Nationality Act to require mandatory detention of aliens who are physically present in the United States, but have not been admitted to the United States.
Sec. 2 Inspection and detention of certain aliens
Inspection— Section 235(b)(2)(A) of the Immigration and Nationality Act (8 U.S.C. 1225(b)(2)(A)) is amended by striking “an alien seeking admission” and inserting “the applicant for admission”.
Mandatory detention— Section 236(c)(1) of the Immigration and Nationality Act (8 U.S.C. 1226(c)(1)) is amended—
in each of subparagraphs (A), (B), and (C), by striking the comma at the end and inserting a semicolon;
in subparagraph (D), by striking “, or” at the end and inserting a semicolon;
in subparagraph (E)(ii), by striking the comma at the end and inserting “; or”; and
by inserting after subparagraph (E) the following:
“(F) is an applicant for admission described in section 235(a)(1),”
