Safe Baby Formula Act of 2026

A BILL

To require the Secretary of Health and Human Services to conduct a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health and establish standards for regulating the content of such substances in infant formula.

Section 1 Short title

This Act may be cited as the “Safe Baby Formula Act of 2026”.

Sec. 2 Study on infant formula

Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall complete a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health.

Sec. 3 Prohibition of toxic metals in infant formula

(a)
Action levels— Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall establish evidence-based action levels with respect to arsenic, cadmium, mercury, and lead in infant formula.
(b)
Requirements for action levels— In establishing an action level under subsection (a), the Secretary shall consider—
(1)
the feasibility of complying with such action level;
(2)
the capacity of the Department of Health and Human Services to enforce such action level for food imported, or offered for import, into the United States; and
(3)
the impact of such action level on domestic food security.

Sec. 4 Definition

In this Act, the term infant formula has the meaning given such term in section 201(z) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(z)).
