This Act may be cited as the “No Deliveries Act”.
No Deliveries Act
A BILL
To amend title 18, United States Code, to establish birth tourism as an offense, and for other purposes.
Sec. 2 Birthing misrepresentations
Section 1546 of title 18, United States Code, is amended—
in subsection (a)—
by striking “or fact—” and inserting “or fact; or”;
by inserting before “Shall be fined” the following:
“Whoever knowingly enters the United States for the purpose of giving birth to a child whose parents are not nationals or lawful permanent residents of the United States and misrepresents such purpose—”
by inserting “not less than 10 years (if the offense resulted in such child being born in the United States) or” before “not more than 25”; and
by adding at the end the following:
“(d) Notwithstanding any other provision of law, a United States district court shall have jurisdiction to enter a judicial order of removal at the time of sentencing against any alien who is convicted of an offense under this section.”
