Conditions for transporting certain distilled spirits— The direct shipment of a distilled spirit by a craft distillery shall be permitted from States where a distilled spirit is purchased from a craft distillery, to another State or the District of Columbia, if—
Violations— If any person fails to meet any of the conditions under subsection (a), the attorney general of any State may bring a civil action under the same terms as those set out in section 2 of the Act entitled “An Act divesting intoxicating liquors of their interstate character in certain cases”, approved March 1, 1913 (commonly known as the “Webb-Kenyon Act”) (27 U.S.C. 122a).
Independently owned— The term independently owned means, with respect to a craft distillery, that no producer that produces more than 250,000 gallons of distilled spirit each year has a direct or indirect ownership interest in such craft distillery.
