This Act may be cited as the “Fund Schools, Not ICE Act”.
Fund Schools, Not ICE Act
A BILL
To transfer certain unobligated funds appropriated to U.S. Immigration and Customs Enforcement under the Secure America Act to the Department of Education to carry out programs under part A of title I of the Elementary and Secondary Education Act of 1965, and for other purposes.
Sec. 2 Transfer of unobligated ICE funds to education programs
Any unobligated funds appropriated to U.S. Immigration and Customs Enforcement under sections 102 and 202 of the Secure America Act (Public Law119–98) shall be transferred to the Department of Education to carry out programs under part A of title I of the Elementary and Secondary Education Act of 1965.
Sec. 3 Sale of immigration detention warehouses
In general— Not later than 60 days after the date of enactment of this Act, the Secretary of Homeland Security shall sell each covered immigration detention warehouse.
Definition— In this section, the term covered immigration detention warehouse means each of the 11 facilities purchased by the Secretary of Homeland Security for the purposes of immigration detention during the period beginning on January 1, 2026, and ending on March 31, 2026.
