A BILL
To amend the Federal Food, Drug, and Cosmetic Act to prohibit the introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS, and for other purposes.
Sec. 2 Prohibition against food packaging containing intentionally added PFAS
In general— Section 301 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amended by adding at the end the following:
“(jjj)
“(1) The introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS.
“(2) In this paragraph, the term PFAS means a class of fluorinated organic chemicals containing at least one fully fluorinated methyl or methylene carbon atom.”
Applicability— The amendment made by subsection (a) applies beginning on January 1, 2027.
