This Act may be cited as the “Destroy Zombie Guns Act”.
Destroy Zombie Guns Act
A BILL
To amend title 18, United States Code, to improve firearm destruction practices, and for other purposes.
Sec. 2 Safe firearm destruction
In general— Section 922 of title 18, United States Code is amended by adding at the end the following:
“(aa) It shall be unlawful for any person engaged in the business of destroying firearms, while destroying or aiding in the destruction of a firearm that has been shipped or transported in interstate or foreign commerce, to not destroy every component of the firearm.”
Definition of “engaged in the business” as applied to a destroyer of firearms— Section 921(a)(21) of such title is amended—
by striking “and” at the end of subparagraph (E);
by striking the period at the end of paragraph (F) and inserting “; and”; and
by adding at the end the following:
“(G) as applied to a destroyer of firearms, a person who devotes time, attention, and labor to the destruction of firearms or firearm components as a regular course of trade or business to predominantly earn a profit through services rendered to facilitate the destruction of a firearm or firearm components.”
Penalties— Section 924(a) of such title is amended by adding at the end the following:
“(9)
“(A) Any person who violates section 922(aa) shall be fined under this title, imprisoned for not more than 2 years, or both, in addition to any penalty imposed on the person under paragraph (2) of this subsection.
“(B) In addition to any penalty imposed under subparagraph (A) of this paragraph on a licensee under this chapter, the Attorney General may, after notice and opportunity for a hearing, suspend the license issued to the licensee in the case of the first violation of section 922(aa), or, in the case of any subsequent violation, shall immediately revoke the license.”
