Recycling Technology Innovation Act

A BILL

To amend the Clean Air Act to exclude certain units of facilities from the definition of solid waste incineration unit, and for other purposes.

Section 1 Short title

This Act may be cited as the “Recycling Technology Innovation Act”.

Sec. 2 Definition of solid waste incineration unit

Section 129(g)(1) of the Clean Air Act (42 U.S.C. 7429(g)(1)) is amended—

by striking “unit.—The term” and inserting

“(A) In general—The term”

(2)
by striking “include (A) materials” and inserting

“(i) materials”

(3)
by striking “metals, (B) qualifying” and inserting

“(ii) qualifying”

(4)
by striking “purposes, or (C) air” and inserting

“(iii) air”

(5)
by striking “rule.” and inserting

“(iv) a unit that converts or transforms plastic or post-use polymers through pyrolysis, gasification, depolymerization, catalytic cracking, solvolysis, or chemolysis into outputs of which at least 50 percent by mass, as calculated via a method determined by the Administrator by rule, are products.”

by adding at the end the following:

“(B) Petitions for treatment

“(i) In general—An owner or operator of a unit that converts or transforms plastic or post-use polymers and that is not described in subparagraph (A)(iv) may submit to the Administrator a petition requesting that such unit be treated as excluded from the definition of solid waste incineration unit.

“(ii) Process—For any such petition, the Administrator shall—

“(I) make publicly available the complete petition;

“(II) seek public comment on the petition; and

“(III) approve or deny the petition not later than 180 days after the date on which the Administrator receives the petition.

“(C) Product defined—In this paragraph, the term product—

“(i) means a material output that—

“(I) is a usable substance or material with a consumer, commercial, or industrial application; and

“(II) can be sold, or used as an input in the manufacture of another product; and

“(ii) does not include—

“(I) electricity, heat, or steam; and

“(II) soot, char, dust, or ash.”
