To amend title XVIII of the Social Security Act to require Medicare Advantage plans to automatically reconsider determinations denying coverage.

A BILL

Section 1852(g)(2)(A) of the Social Security Act (42 U.S.C. 1395–22(g)(2)(A)) is amended—

(1)

by striking “a determination” and inserting “each determination”;

(2)

by striking “upon request by the enrollee involved”; and

(3)

by striking “of the receipt of the request for reconsideration” and inserting “on which the determination described in paragraph (1)(B) is made”.
