Covered mortgage loan— The term covered mortgage loan includes any consumer credit transaction (within the meaning of such term as used in the Truth in Lending Act (
15 U.S.C. 1601 et seq.)), other than temporary financing such as a construction loan, that is secured by a mortgage, deed of trust, or other consensual security interest on a 1- to 4-unit dwelling or on residential real property that includes a 1- to 4-unit dwelling including individual units of condominiums and cooperatives that is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) designed principally for the occupancy of from 1 to 4 families, including any such secured loan the proceeds of which are used to prepay or pay off an existing loan secured by the same property, but such term does not include a credit transaction under an open-end credit plan other than a reverse mortgage.
