Section 1 Short title

added This Act may be cited as the “Servicemember Residence Protection Act”.

(a)
removed Preemption— The Servicemembers Civil Relief Act (54 Stat. 1178; 50 U.S.C. 3901 et seq.) is amended by inserting, after section 301, the following new section:

removed “Any State law establishing squatter’s rights shall not apply to premises—

removed “(1) owned by a servicemember; and

removed “(2) occupied by a squatter during a period of military service of such servicemember.”

(b)
removed Clerical amendment— The table of contents in section 1(b) of such Act (50 U.S.C. 3901(b)) is amended by inserting after the item relating to section 301 the following new item:

Sec. 2 Servicemembers Civil Relief Act: tolling of period of adverse possession

(a)
added In general— Section 206 of the Servicemembers Civil Relief Act (50 U.S.C. 3936) is amended by adding at the end the following new subsection:

added “(d) Tolling of period of adverse possession—The period of a servicemember's military service may not be included in computing a period of adverse possession of such servicemember’s real property.”

(b)
added Website— Not later than 45 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall update the website of the Department of Veterans Affairs regarding such Act to include information and resources regarding—
(1)
added how a member of the uniformed services may secure real property while absent for a period of military service;
(2)
added leasing real property; and
(3)
added landlord-tenant rights and obligations.
