Section 1 Withdrawal of proposed Endangered Species Act of 1973 rules

(a)
Withdrawal of proposed rules—
(1)
USFWS and NMFS rules— The Director of the United States Fish and Wildlife Service and the Assistant Administrator for Fisheries of the National Oceanic and Atmospheric Administration shall withdraw the following proposed rules:
(A)
The proposed rule of the United States Fish and Wildlife Service and the National Marine Fisheries Service entitled “Endangered and Threatened Wildlife and Plants; Revision of Regulations for Interagency Cooperation” (88 Fed. Reg. 40753 (June 22, 2023)).
(B)
The proposed rule of the United States Fish and Wildlife Service and the National Marine Fisheries Service entitled “Endangered and Threatened Wildlife and Plants; Listing Endangered and Threatened Species and Designating Critical Habitat” (88 Fed. Reg. 40764 (June 22, 2023)).

USFWS rule— The Director of the United States Fish and Wildlife Service shall withdraw the proposed rule of the United States Fish and Wildlife Service entitled “Endangered and Threatened Wildlife and Plants; Regulations Pertaining to Endangered and Threatened Wildlife and Plants” (88 Fed. Reg. 40742 (June 22, 2023)).
(b)
No finalization, implementation, or enforcement— The Director of the United States Fish and Wildlife Service and the Assistant Administrator for Fisheries of the National Oceanic and Atmospheric Administration, as applicable, may not take any action to finalize, implement, or enforce the proposed rules described in paragraphs (1) and (2) of subsection (a).
