(a)
Definitions— In this Act:

Competency-based education— The term competency-based education means an approach in higher education that organizes academic content or delivery according to competencies (an individual student’s demonstrated skills that are necessary for the student to successfully perform a specific task, job role, or function) rather than using courses taught during instructor- or institutionally-established timeframes that may conclude before a student has demonstrated mastery of the course material.

Skill— The term skill means knowledge or an ability, which is described in a way that communicates discrete, discernable value an individual can demonstrate or acquire.
(b)
Competency-Based education programs— In administering competency-based education programs, or determining the eligibility of competency-based education programs to receive Federal assistance, the Department of Education shall comply with the regulations in parts 600, 602, and 668 of title 34, Code of Federal Regulations, as in effect on July 1, 2021.
