PFAS-Free Procurement Act of 2023

A BILL

To prohibit the procurement of certain items containing perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA) and prioritize the procurement of products not containing PFAS.

Section 1 Short title

This Act may be cited as the “PFAS-Free Procurement Act of 2023”.

Sec. 2 Prohibition on procurement of certain items containing perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA)

Beginning on October 1, 2025, the head of an executive agency may not enter into a contract for the procurement of cookware, utensils, carpets, or furniture that contain perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA).

Sec. 3 Priority procurement of products not containing PFAS

The head of an executive agency shall prioritize the procurement of products, where available, that do not contain PFAS.

Sec. 4 Definitions

In this Act:

Executive agency defined— The term executive agency has the meaning given the term in section 133 of title 41, United States Code.
(2)
PFAS— The term PFAS means a perfluoroalkyl or polyfluoroalkyl substance that is man-made and has not fewer than 1 fully fluorinated carbon atom.
