Timely Initiation to Modify Executive Rulemaking Act

A BILL

To amend title 28, United States Code, to clarify the limitations period during which an action may be commenced for judicial review of a final rule.

Section 1 Short title

This Act may be cited as the “Timely Initiation to Modify Executive Rulemaking Act” or the “TIMER Act”.

Sec. 2 Statute of limitations

Section 2401 of title 28, United States Code, is amended—
(1)
in subsection (a), by inserting after “chapter 71 of title 41” the following: “and subject to subsection (b)”;
(2)
by redesignating subsection (b) as subsection (c); and
(3)
by inserting after subsection (a) the following:

“(b) A civil action commenced against the United States under chapter 7 of title 5, United States Code, for judicial review of a final rule shall be barred unless the complaint is filed within six years after the date on which the final rule is issued.”
