A BILL
To amend title XVIII of the Social Security Act to prohibit the use of an inpatient-only list in designating hospital outpatient services under the Medicare program.
2. Prohibiting the use of an inpatient-only list in designating hospital outpatient services under the Medicare program
Section 1833(t)(1) of the Social Security Act (42 U.S.C. 1395l(t)(1)) is amended by adding at the end the following new subparagraph:
“(C) Prohibition on use of an inpatient-only list—In designating outpatient hospital services pursuant to subparagraph (B)(i), the Secretary may not refuse to so designate such a service based solely on the Secretary’s determination that such service may only be safely furnished in an inpatient setting.”
