Restricting Environmental Gamesmanship Act

A BILL

To prohibit Federal agencies from implementing environmental justice standards when issuing rules, and for other purposes.

Section 1 Short title

This Act may be cited as the “Restricting Environmental Gamesmanship Act” or the “REG Act”.

Sec. 2 Limitation on agency rule making

(a)
Definitions— In this section, the terms agency and rule have the meanings given those terms in section 551 of title 5, United States Code.
(b)
Prohibition— In promulgating a rule or administering a duly enacted law of the United States an agency may not consider environmental justice unless the agency is required to by law.

Sec. 3 Repeal of Executive Orders

Effective beginning on the date of enactment of this Act, the following Executive orders shall have no force or effect:
(1)
Executive Order 12898 (42 U.S.C. 4321 note; relating to Federal actions to address environmental justice in minority populations and low-income populations).
(2)
Executive Order 14008 (42 U.S.C. 4321 note; relating to tackling the climate crisis at home and abroad).
(3)
Executive Order 14096 (42 U.S.C. 4321 note; relating to revitalizing our Nation’s commitment to environmental justice for all).
