Show Me the Science Act
A BILL
To amend title 5, United States Code, to require the publication of scientific data, incident data, or other pertinent data relied on by an agency to justify a rule.
Sec. 2 Rulemaking requirements
“(f)
“(1) The publication of a rule under subsection (d) shall include the scientific data, incident data, or other pertinent data relied on by the agency to justify the rule, except in the case that the head of the agency—
“(A) determines, on a nondelegable basis, that publication of such data would impede public safety or security;
“(B) submits to the Administrator of the Office of Information and Regulatory Affairs (referred to in this subsection as the “Administrator”) a notification disclosing the reasons for the determination under subparagraph (A); and
“(C) publishes such notification, consistent with public safety, security, and privacy interests, in the Federal Register.
“(2) The Administrator shall issue guidance for agencies on compliance with this section and shall monitor such compliance.
“(3) In this subsection, the term scientific data means recorded factual material that is commonly accepted in the scientific community and is of sufficient quality to validate and replicate research findings.”
