Ensuring Health in SNAP Act of 2024
A BILL
To amend section 7 of the Food and Nutrition Act of 2008 to permit State agencies to restrict the use of supplemental nutrition assistance program benefits to prevent the purchase of soft drinks, candy, ice cream, and prepared desserts (such as cakes, pies, cookies, and similar products).
Sec. 2 Amendment
“(l) State option To restrict purchase of certain items
“(1) In general—Notwithstanding any other provision of this Act, a State agency may, at its discretion, ban the use of supplemental nutrition assistance program benefits for the purchase of soft drinks, candy, ice cream, prepared desserts such as cakes, pies, cookies, and similar products, as designated by the Secretary.
“(2) Designation by the Secretary—The Secretary shall issue and update as necessary a list of specific items that fall under the categories described in paragraph (1).
“(3) No approval required—The implementation of any restrictions under paragraph (1) shall be at the sole discretion of the State agency and shall not require approval from the Secretary.
“(4) No reporting required—State agencies that exercise the option established by this subsection shall not be required to submit reports regarding the implementation or results of such restrictions outside the normal reporting requirements of the program.”
