Not later than 90 days after the date of the enactment of this Act, the head of each agency shall submit to Congress a report describing the application of chapter 6 of title 5, United States Code (commonly know as the “Regulatory Flexibility Act”), with respect to each rule of the agency. Such report shall include—
(1)
any definitions used by the agency to determine a “significant economic impact” and a “substantial number of small entities”, as such terms are used in such chapter 6; and
(2)
a comprehensive list of factors considered by the agency in applying such terms in any regulatory flexibility analyses of such agency.
