This Act may be cited as the “Robert E. Lee Monument Removal Act”.
Robert E. Lee Monument Removal Act
A BILL
To direct the Secretary of the Interior to remove the Robert E. Lee Monument at Antietam National Battlefield, and for other purposes.
Sec. 2 Definitions
In this Act:
Monument— The term monument means the statue of the Confederate General Robert E. Lee that stands on property, known as the historic Newcomer House and Farmstead, acquired in 2005 by the National Park Service as part of the expansion of Antietam National Battlefield.
Secretary— The term Secretary means the Secretary of the Interior.
Sec. 3 Removal of monument
Removal— As soon as practicable, the Secretary shall—
remove the monument from National Park Service property for destruction pursuant to subsection (b); and
restore the site of the monument in a manner consistent with the protection and interpretation of the Antietam National Battlefield.
Destruction of monument—
In general— The Secretary shall procure the services of a private entity to destroy the monument.
Sale of materials— The Secretary may sell the raw materials of the destroyed monument as scrap and may retain such proceeds of such sale as may be necessary to offset the costs of procuring services described in paragraph (1).
Status of materials— For the purposes of subchapters II and III of chapter 5 of subtitle I of title 40, United States Code, the raw materials of the statue shall not be considered “excess property” or “surplus property”.
Plan— Before removing the monument, and not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the Committee on Natural Resources of the House of Representatives a plan with respect to removing and destroying the monument, including the timeline for removal.
