Section 1 Short title
This Act may be cited as the “Grant Relief for American Children’s Elevation Act of 2023” or the “GRACE Act”.

A BILL
To amend the Immigration and Nationality Act to establish certain family separation as an exceptional and extremely unusual hardship, and for other purposes.
Sec. 2 Exceptional and extremely unusual hardship
Section 240A(b) of the Immigration and Nationality Act (8 U.S.C. 1229b) is amended by adding at the end the following:
“(7) Exceptional and extremely unusual hardship defined—In this subsection, the term “exceptional and extremely unusual hardship” shall include hardship resulting from separating a family member who is a United States citizen, a lawful permanent resident or an individual lawfully admitted to the United States and a family member who is subject to deportation or removal from the United States.”
