Deterring Attempts at Dirty Deals by Youngsters Act

A BILL

To prohibit immediate family members of executive branch officials from using their family’s influence to benefit in foreign business dealings, and for other purposes.

Section 1 Short title

This Act may be cited as the “Deterring Attempts at Dirty Deals by Youngsters Act” or the “DADDY Act” .

Sec. 2 Limit on foreign employment of immediately family of certain officials

(a)
In general— An immediate family member of a covered person may not be employed by a foreign company.
(b)
Penalty— Any individual who willfully violates subsection (a) shall be fined not more than $250,000 or imprisoned for not more than 5 years, or both.
(c)
Effective date— This Act shall take effect on the date that is two weeks after the date of the enactment of this Act.
(d)
Definitions— In this Act:
(1)
Covered foreign country— The term covered foreign country means any country other than—
(A)
the United States;
(B)
a country that is a member of—
(i)
the North Atlantic Treaty Organization; or
(ii)
the Five Eyes Alliance;
(C)
Japan;
(D)
the Republic of Korea; or
(E)
Israel.
(2)
Covered person— The term covered person means the—
(A)
President;
(B)
Vice President;
(C)
Secretary of State;
(D)
Secretary of the Treasury;
(E)
Secretary of Defense;
(F)
Attorney General;
(G)
Secretary of the Interior;
(H)
Secretary of Agriculture;
(I)
Secretary of Commerce;
(J)
Secretary of Labor;
(K)
Secretary of Health and Human Services;
(L)
Secretary of Housing and Urban Development;
(M)
Secretary of Transportation;
(N)
Secretary of Energy;
(O)
Secretary of Education;
(P)
Secretary of Veterans Affairs;
(Q)
Secretary of Homeland Security; and
(R)
Director of National Intelligence.
(3)
Five Eyes Alliance— The term Five Eyes Alliance means the group consisting of Australia, Canada, New Zealand, the United Kingdom, and the United States.
(4)
Foreign company— The term foreign company means a company that is organized under the laws of or has its principal place of business in a covered foreign country.
(5)
Immediate family member—
(A)
In general— The term immediate family member means a spouse, child, mother, father, sibling, grandchild, son-in-law, daughter-in-law, sister-in-law, and brother-in-law.
(B)
Adopted and step-relatives— For the purposes of subparagraph (A)—
(i)
the term child includes any stepchild, foster child, and adoptive child with whom the individual has a regular parent-child relationship; and
(ii)
the term sibling includes any step-sibling and adopted sibling.
