Substance Wastewater Inspection For Trends in Detection Act of 2023

A BILL

To amend the Public Health Service Act to fund detection and testing activities, such as wastewater surveillance, to detect synthetic opioids, and for other purposes.

Section 1 Short title

This Act may be cited as the “Substance Wastewater Inspection For Trends in Detection Act of 2023” or the “SWIFT Detection Act of 2023”.

Sec. 2 Use of grants by States, localities, and Indian Tribes to conduct wastewater surveillance

Section 392A(a)(3)(A) of the Public Health Service Act (42 U.S.C. 280b–1(a)(3)(A)) is amended by inserting “, including through the use of wastewater surveillance to identify trends associated with controlled substance use if it is determined by appropriate evidence that wastewater surveillance is an effective way to survey controlled substance use within a community” before the semicolon.

Sec. 3 Pilot program for public health laboratories to detect fentanyl and other synthetic opioids

Section 7011(b) of the SUPPORT for Patients and Communities Act (42 U.S.C. 247d–10 note) is amended—
(1)
in paragraph (2), by striking “and” at the end;
(2)
in paragraph (3), by striking the period at the end and inserting “; and”; and
(3)
by adding at the end the following:

“(4) public, private, and academic entities with expertise in detection and testing activities, such as wastewater surveillance, with respect to synthetic opioids, including fentanyl and its analogues.”
