Asylum Claims Improvement Act of 2023

A BILL

To amend the Immigration and Nationality Act to limit the ability to take into account the mental health of an applicant for asylum.

Section 1 Short title

This Act may be cited as the “Asylum Claims Improvement Act of 2023”.

Sec. 2 Mental health consideration

(a)
Asylum— Section 208(b) of the Immigration and Nationality Act (8 U.S.C. 1158(b)) is amended by adding at the end the following:

“(4) For purposes of the consideration of a claim of asylum by an alien under this subsection, the mental health of the alien may not be taken into account.”

(b)
Withholding of removal— Section 241(b)(3) of the Immigration and Nationality Act (8 U.S.C. 1231(b)(3)) is amended by adding at the end the following:

“(D) For purposes of a determination under this paragraph, the mental health of the alien may not be taken into account.”
