Defund the CCP On Campus Act of 2023

A BILL

To prohibit the availability of Federal funds to institutions of higher education that fund Confucius Institutes.

Section 1 Short title

This Act may be cited as the “Defund the CCP On Campus Act of 2023”.

Sec. 2 Prohibition on funding for a Confucius Institute

(a)
In general— No Federal funds may be made available to any institution of higher education that—
(1)
provides funds to a Confucius Institute or to an entity that funds such an Institute; or
(2)
has a Confucius Institute.
(b)
Study— Not later than 6 months after the date of enactment of this Act, the Secretary of Education shall submit to Congress the results of a study that reviews, for the preceding 10-year period—
(1)
the number of institutions of higher education that have funded or provided funds to an entity that has funded a Confucius Institute; and
(2)
the number of institutions of higher education at which a Confucius Institute has operated.
(c)
Definitions— In this Act:
(1)
Confucius Institute— The term “Confucius Institute” means a public educational and cultural promotion program funded and arranged by a government-organized group under the Ministry of Education of the People’s Republic of China.
(2)
Institute of higher education— The term “institution of higher education” has the meaning given the term in section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002), except that such term does not include institutions of higher education described in subsection (a)(1)(C) of such section 102.
