Beryllium Testing Fairness Act

A BILL

To amend the Energy Employees Occupational Illness Compensation Program Act of 2000 to expand the ways beryllium sensitivity can be established for purposes of compensation under that Act and to extend the authorization of the Advisory Board on Toxic Substances and Worker Health of the Department of Labor, and for other purposes.

Section 1 Short title

This Act may be cited as the “Beryllium Testing Fairness Act”.

Sec. 2 Amendments to the Energy Employees Occupational Illness Compensation Program Act of 2000

(a)
Modification of demonstration of beryllium sensitivity— Section 3621(8)(A) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7384l(8)(A)) is amended—
(1)
by striking “established by an abnormal” and inserting the following:

“(i) an abnormal”

(2)
by striking the period at the end and inserting “; or”; and
(3)
by adding at the end the following:

“(ii) three borderline beryllium lymphocyte proliferation tests performed on blood cells.”

(b)
Extension of Advisory Board on Toxic Substances and Worker Health— Section 3687(j) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7385s–16(j)) is amended by striking “10 years” and inserting “15 years”.
